Terms of Service
1. Acceptance
By accessing or using swanseek ("we", "us", "the service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the service.
2. The service
swanseek publishes quantitative analyses of crypto asset market structure ("patterns") and a periodic market summary ("daily brief"). Content is produced by an automated detection pipeline with a synthesis layer.
3. Nature of the content
Content published by swanseek is not financial advice. It is not a recommendation to buy, sell, or hold any asset, and is not a solicitation or offer of any security or financial product. Nothing in our content should be construed as individualized advice of any kind.
Content is not personalized and will not become personalized. We do not tailor patterns, scores, narratives, ranking, or the daily brief based on your identity, location, viewing history, saved items, or any other signal associated with your account. Every subscriber receives the same underlying content.
Content reflects observation, not prediction. Historical references, confidence scores, and any characterization of rarity, structure, or signal strength describe the state of detection at the time of publication. Nothing in the content guarantees any future outcome. Past patterns do not guarantee future results.
4. No advisory relationship
No advisory, fiduciary, brokerage, or professional relationship of any kind is created between you and swanseek by your use of the service, by any communication we send, or by any account you maintain with us. We are not your investment adviser, broker, dealer, financial planner, accountant, tax adviser, or attorney. If you need advice specific to your circumstances, consult a licensed professional.
5. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract in your jurisdiction. You are responsible for ensuring that your use of swanseek is lawful where you are located. The service may be unavailable in certain jurisdictions. [Jurisdiction-specific restrictions to be finalized with counsel.]
6. Accounts
Some features require an account. You are responsible for the accuracy of the information you provide and for safeguarding your credentials. Notify us immediately of any unauthorized access. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security or compliance risk.
7. Fees and subscriptions
[Placeholder — fee structure, billing, cancellation, refund, and auto-renewal terms to be inserted when pricing launches.] If you subscribe to a paid tier, the specific terms of that tier supplement these Terms and, to the extent of conflict, control for the matters they address.
8. Acceptable use
You agree not to:
- resell, redistribute, syndicate, or publicly post our content without written permission;
- scrape, mirror, or otherwise systematically access the service beyond ordinary use;
- reverse engineer the detection or synthesis systems, or attempt to derive underlying datasets;
- use the service to train or fine-tune a machine learning system without written permission;
- misrepresent the service as your own, co-branded, or affiliated in a way we have not authorized;
- use the service for any unlawful purpose, including market manipulation, insider trading, or sanctions evasion.
9. Intellectual property
All content published by swanseek — including patterns, narratives, scores, briefs, software, visual design, and trademarks — is owned by swanseek or its licensors and is protected by applicable intellectual property laws. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to access and read content for your own informational purposes.
10. Disclaimer of warranties
The service is provided "as is" and "as available". To the maximum extent permitted by law, swanseek disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, timeliness, and uninterrupted availability. We do not warrant that any pattern, narrative, score, or brief is accurate, complete, current, or suitable for any use. Detection systems can be wrong. Data sources can be wrong. You understand that you are responsible for evaluating the information before acting on it.
11. Limitation of liability
To the maximum extent permitted by law, swanseek, its affiliates, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or trading opportunities, arising out of or related to your use of the service, even if advised of the possibility of such damages. To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the service is limited to the greater of (a) the amounts you paid us in the twelve months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100).
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability will be limited to the greatest extent permitted by law.
12. Indemnification
You agree to indemnify and hold harmless swanseek and its affiliates, officers, employees, and contractors from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) your use of the service, (b) your breach of these Terms, (c) your violation of applicable law, or (d) any trading or investment decision you make, whether or not informed by content you accessed through the service.
13. Termination
You may stop using the service at any time. We may suspend or terminate your access at any time, with or without cause, with or without notice. Sections that by their nature should survive termination — including Sections 3, 4, 9, 10, 11, 12, and 15 — will survive.
14. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will update the "last updated" date above and, where we believe it appropriate, provide additional notice. Your continued use of the service after changes become effective constitutes acceptance.
15. Governing law and disputes
[Placeholder — governing law, venue, arbitration clause (with opt-out mechanism where required), and class-action waiver to be finalized with counsel. Jurisdiction-specific consumer-protection carve-outs will be honored.]
